Navistar drops lawsuit against EPA

Navistar has dropped a lawsuit against the Environmental Protection Agency's certification policies for Selective Catalytic Reduction-equipped trucks.

According to the suit EPA policy allowed SCR-equipped trucks to operate for "extended periods without any control of NOx emissions" and that the authority was "certifying SCR engines as meeting NOx emission requirements when they do not". The manufacturer also said that the EPA had adopted the standard without the proper public process required by law.

As part of the settlement, the EPA has agreed to engage in a public process to examine its policies for 2011 and later model engines.

Jack Allen, president of Navistar's North American Truck Group, said: "We are pleased with this agreement and look forward to participating in the public process. We believe that with full and open public participation EPA will develop a new approach that will result in equal enforcement of the 2010 NOx requirements for all engine makers."

Navistar's MaxxForce DT mid-range diesel engines and MaxxForce 13 big bore diesel engines have been certified for EPA2010 specifications. The engines meet the EPA's emissions standards through a mixture of Exhaust Gas Recirculation (EGR) and emissions credits the company has accrued, and do not require the use of Diesel Exhaust Fluid (DEF).

Navistar dropped a similar suit against the Californian Air Resources Board last month.
